These Terms and Conditions (hereinafter called “Conditions”) govern the Equator Legend Programme operated by or on behalf of Hotel Equatorial Shanghai (hereinafter called “HES”) and our relationship with members of the Programme (hereinafter called “Members” or “You”). Membership of the Programme is subject to these Conditions, which are the only conditions that apply to the Programme. Hotel Equatorial Shanghai reserves the right to amend or modify these Conditions at its discretion at any time without prior written notice to Members. When redeem benefits and services associated with the Programme, you agree that:
a. You have read, understood and accepted these Conditions;
b. You are eligible for Membership; and
1. MEMBERSHIP WITH THE PROGRAMME
1.1 When you join the Programme, you will be assigned an Equator Legend membership number. It is the members' responsibility to quote their Equator Legend membership number when making reservations and check-in.
1.2 Membership is complimentary and is available only to individuals, not to companies, partnerships, associations, responsibility to ensure your eligibility and you will indemnify against all liabilities, cost, claims, and/or expenses incurred for any breach of this provision. You can not have more than one membership.
1.3 Membership entitles members to benefits and services according to entitlements as described on Equator Legend website and relevant further information within these terms and conditions.
1.4 Memberships are not transferable and may only be used by the registered member.
1.5 You may cancel your Membership at any time with written notification to the Hotel. Cancellation is immediately effective upon receipt of your cancellation request and all membership entitlements will be forgone upon such cancellation.
1.6 HES reserve the right to inconsistent with the Equator Legend membership of any Member who is found to be using the Programme. HES also reserve the right to discontinue membership of any Member who acts in a manner inconsistent with the spirit of the Equator Legend Programme. Discontinued membership will result in the loss of all membership entitlements.
1.7 Any Member who has not stayed at Hotel Equatorial Shanghai at least once in 12 consecutive months may be removed from the list of active Members and if so, is subject to forfeiture of all benefits and services. A Member may reactivate his or her account by any means that HES may establish.
1.8 Unless otherwise stated, all benefits available to Member through the Programme are subject to availability and certain benefits may be excluded from certain volume room night agreements.
1.9 HES reserves the right to add, modify, delete or otherwise change any of the terms, conditions, benefits and services pertaining to the Programme at its sole discretion, at any time and without prior notice.
1.10 All interpretation of the Programme’s Terms and Conditions shall be at the sole discretion of HES.
2. TIERS OF MEMBERSHIP
2.1 Jade: Start your Equator Legend journey, you just enroll & spend your experience in Hotel Equatorial Shanghai.
2.2 Sapphire: You can enroll as a Sapphire member once you stay 10 qualified room nights at HES within 12 consecutive months. When you subsequently accumulate more points in a specific period of time, you can be upgraded to a higher tier of membership. Otherwise, please refer to point 1.7.
2.3 Gold: Stay 20 qualified room nights at HES within a 12 consecutive months and you will be eligible for Gold membership. When you subsequently accumulate more points in a specific period of time, you can be upgraded to a higher tier of membership. Otherwise, please refer to point 1.7.
2.4 Platinum: To enroll as a Platinum member, simply accumulate a total of 30 qualified room nights within 12 consecutive months. When you subsequently accumulate more points in a specific period of time, you can be upgraded to a higher tier of membership. Otherwise, please refer to point 1.7.
2.5 Diamond: To enroll as a Diamond member, simply accumulate a total of 40 qualified room nights within 12 consecutive months. Diamond member is the highest level of commitment. Who has not stayed at Hotel Equatorial Shanghai at least once in 12 consecutive months may be removed from the list of active Members; however, Diamond Member may restart & entitle the benefits from the Sapphire Level.
2.6 The membership will be upgraded in 12 consecutive months from the registration date as one cycle year. At the beginning of each registration cycle year, the system will re-accumulate the room nights from the zero. The room nights of the previous registration period will not be accumulated as the upgrade conditions to the next registration cycle year.
2.7 Every effort will be made to invite guests to join Equator Legend when the above targets are met. However, we ask that you inform us if you have reached these targets and not yet been invited to join the Programme.
2.8 The Programme will not recognize number of stays offered on a complimentary basis, pre-paid, long-stay, series group, aircrew, airline industry rate, discount rate, free rooms, free vouchers & barter agreement.
3.1 The personal data supplied by Members is required for the operation of the Equator Legend Programme, delivery of associated benefits and services, programme development and to communicate news and information to Members for their benefits.
3.2 Members have the responsibility of keeping Equator Legend up-to-date as to their correct communication/postal address.
